I was in a car accident in Florida in September 2020. These screenshots are also from 2020. I was rear-ended when I was at a red stoplight and she was on her phone doing highway speeds. My car has already been fixed and paid for by State Farm, she rear-ended me at such high speeds that she couldn’t even get in and out of her driver's door and had to use a different door. I went to the hospital for neck pain and had 4 MRIs, 4 CTs, and an X-ray. I had some spinal injuries such as reversal of cervical lordosis, loss of space between discs in the c spine, syringobulbia/syringomyelia determined to be from the accident, sprain of ligaments in the c spine and t spine, and others that I can’t remember right now. I had to wear a neck brace for a short while and had many follow-up appointments with my PCP. I did 13 sessions of PT before insurance would no longer pay for it, so I had to stop. I wasn’t able to work for a couple of months and when I went back to work, I had to quit a few months later, because it was too hard with my injuries. I didn’t return to work for about a year. I still have migraines often and I used to have them all day, every day. I had to miss out on my child’s events and family gatherings bc my migraines were so bad and nothing helped. I recently got the hospital bill from the accident and it was $120,000, but insurance negotiated it down to a few thousand and I have to pay them asap. I also have to have yearly MRIs as advised by my PCP and two neurologists, insurance will only cover a CT, so I had to pay out of pocket which was about $1,600 each. I don’t live in Florida anymore and I’m just tired of dealing with this. I feel like this is low considering how much pain and suffering it’s caused and how much work I missed. I also don’t want a limit of 180 days on the medical part considering that I will continue to have these MRIs every year. My question is, is there a way a lawyer can negotiate the settlement without going through a lawsuit? Or any helpful tips for me to negotiate it myself?
